End User License Agreement
The terms for installing and using the Curtains desktop app.
On this page
The short version
- This agreement covers the Curtains app. It’s between you and Miscreants, LLC, which makes Curtains and licenses it to you. We license Curtains; we don’t sell it.
- Stripe is the seller of paid plans. Stripe’s terms cover the purchase. This agreement covers how you use the software.
- Free works on any number of your devices. Pro and Lifetime cover one person on up to 3 devices, and Pro for teams 3 per seat.
- Don’t get around the plan limits or the license checks, and don’t redistribute the app.
- Every plan gets every update. Curtains checks for them and you choose when to install.
- Your screen stays on your device. See the Privacy Policy.
- The app comes as is, and our liability is limited, as far as the law allows.
Who this agreement is between
This End User License Agreement (“agreement”) is between you and Miscreants, LLC, a limited liability company organized in New York (“we”, “us”), the developer and licensor of Curtains. It covers the Curtains desktop app for macOS and Windows, its updates, and any documentation that comes with it (“Curtains”).
You accept this agreement by installing or using Curtains. If you use Curtains for an organization, you accept it for that organization too. If you don’t agree, don’t install or use Curtains.
Who sells paid plans
Paid plans are sold through Stripe Managed Payments, with Stripe as the seller (the merchant of record). Stripe’s terms apply to the purchase itself: the payment, tax, receipts and billing. This agreement governs your use of the software, whichever plan you’re on, and the Terms of Service govern your account and plan. If they conflict about the app, this agreement wins.
Your license
We grant you a personal, non-exclusive, non-transferable license to install and use Curtains, for your own presenting, personal or for work, on computers you own or control, as your plan allows:
- Free: on any number of your devices, sharing up to 2 windows at a time, with the “Shared with Curtains” badge on.
- The trial: Pro for 14 days from the first launch on a device, then Free.
- Pro and Lifetime: for one person, on up to 3 activated devices.
- Pro for teams: for the person holding each seat, on up to 3 activated devices per seat, for as long as the seat is assigned to them.
The license for a paid plan lasts for the period you paid for: a year for Pro and Pro for teams, until they renew, and with no end date for Lifetime. If a payment is refunded or reversed, the license for that plan ends; please deactivate the devices you activated with it.
What each plan includes
Paid plans and the trial share up to 6 windows at a time, let you turn the “Shared with Curtains” badge off (not during the trial), and add custom backgrounds and overlays. Every other feature is on every plan, Free included. The pricing page has the current details.
What you may not do
Except where the law gives you a right that can’t be taken away, you may not:
- Get around, disable or interfere with the plan limits, the trial, the badge, passes, device activation or any other license check.
- Copy, forge, share or sell passes, or move a pass to a device it wasn’t issued for.
- Copy, modify or make works based on Curtains, apart from copies you need to install and use it.
- Reverse engineer, decompile or disassemble Curtains, except as far as the law expressly allows despite this limit.
- Rent, lease, lend, sell, sublicense or redistribute Curtains, or offer it as a hosted service.
- Remove or change any copyright, trademark or other notice in Curtains.
- Use Curtains to break the law or anyone’s rights, including recording or broadcasting people without the consent the law requires.
Passes and activation
To use a paid plan, you activate each device on curtains.app. We then issue a pass: a small signed file bound to that device by a device ID, a one-way hash of the computer’s hardware ID. Curtains checks the pass on your device, without going online.
- To move a plan to another device, deactivate the old one (Deactivate this device on Studio’s Account page, or from your account page on curtains.app), then activate the new one.
- A Pro or team pass covers the year you paid for, plus 14 days. Renew it in one click from Studio’s Account page, or turn on Renew my pass automatically.
- Without a valid pass, Curtains runs the trial while it lasts, then Free. Losing a pass never deletes your settings, combos or themes.
Updates
Every plan, Free included, gets every update.
- Checking. Curtains checks for a new version on launch and once a day. The check sends nothing about you, your screen or your windows. Turn it off with Check for updates in Settings › Privacy & updates.
- Installing. When an update is ready, Curtains tells you, and you choose when to install it. It never installs while you’re sharing.
- Signed updates. Curtains installs only updates signed with our update key, and only a version newer than the one you have.
- Changes. Updates may add, change or remove features. This agreement covers every update unless it comes with its own terms.
- Support. We may stop supporting older versions of Curtains or of macOS or Windows.
Permissions and your data
On macOS, Curtains asks for the Screen Recording permission, so it can capture the windows you pick, and can ask for Accessibility, so it can resize your windows and bring them to the front. It uses them only for those things.
Frames live in memory on your device and are never written to disk or sent to us. Call detection runs on your device only. Anonymous usage stats are optional and contain no screen content. The Privacy Policy has the details.
What you share
Curtains shows only the windows you pick, and works hard to keep everything else off the canvas. But you’re responsible for what you share and for checking the canvas before you go Live. We can’t control what meeting apps, the operating system or other apps do, and an update to any of them can change how Curtains behaves.
Open-source components
Curtains includes open-source software. Each open-source component is licensed under its own license, which applies to that component instead of this agreement wherever the two conflict. Nothing in this agreement limits your rights under those licenses.
Ownership
Curtains is licensed, not sold. We and our licensors own Curtains and all rights in it, including copyrights, trademarks and the “Curtains” name and logo. You get only the rights this agreement grants.
Ending this agreement
- You can end this agreement at any time by deleting Curtains from your devices.
- It ends automatically if you break it. You must then stop using Curtains and delete it.
- A paid plan ending doesn’t end this agreement: Curtains goes back to Free, which you may keep using.
The sections on restrictions, ownership, disclaimers, liability and governing law keep applying after this agreement ends.
Disclaimer of warranties
To the extent the law allows, Curtains is provided “as is” and “as available”, with all faults and without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We don’t warrant that Curtains will be uninterrupted or error-free, that it will meet your needs, or that no window, notification or content you didn’t pick will ever appear on the canvas.
Some places don’t allow these exclusions. If you’re a consumer, you keep the warranties and rights the law gives you that can’t be excluded.
Limitation of liability
To the extent the law allows:
- We’re not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, or for content shown during a screen share, even if we were told they might happen.
- Our total liability under this agreement is limited to the greater of the amount you paid for Curtains in the 12 months before the claim and US$25.
These limits don’t apply to liability that can’t be limited by law, such as for fraud, or for death or personal injury caused by negligence. If you’re a consumer in the EU or the UK, we’re liable under the law for foreseeable loss we cause by breaking this agreement or by failing to use reasonable care and skill.
Export rules
You may not use, export or re-export Curtains in breach of US export laws or sanctions, or those of any other country that apply, including to a sanctioned country or person.
US government users
Curtains is commercial computer software and documentation. Government users get only the rights this agreement gives everyone else.
Governing law and disputes
This agreement is governed by the laws of the State of New York, without regard to its conflict of laws rules. Disputes are handled as the Terms of Service set out, in the state and federal courts located in New York County, New York. If you’re a consumer, you keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.
General
This agreement, together with the Terms of Service, is the whole agreement between you and us about the Curtains app. If part of it doesn’t hold, the rest still applies. Not enforcing a term right away doesn’t mean we give it up. You may not transfer this agreement; we may transfer it to a company that takes over Curtains. We may update this agreement as the Terms of Service describe.
