Terms of Service
The agreement for your Curtains account, your plan and curtains.app.
On this page
The short version
- These terms cover your account, your plan and curtains.app. The License Agreement covers the app itself.
- Stripe sells paid plans. When you buy, you buy from Stripe as the seller, and Stripe’s terms for the purchase apply too.
- Free costs nothing. Every install starts with 14 days of Pro, with no account and no card.
- Pro and Pro for teams renew every year until you cancel. Cancel any time in the billing portal; your plan runs to the end of the year you paid for.
- A paid plan covers 3 devices per person. Lifetime is personal and paid once, with every future update.
- Refunds go through Stripe, as the seller, or are at our discretion. See the Refund Policy.
- We may show your organization’s name and logo as a customer. Email us and we’ll take it down.
- Use Curtains lawfully, and only share what you have the right to share.
Who we are and what these terms cover
Curtains is made by Miscreants, LLC, a limited liability company organized in New York (“we”, “us”). These Terms of Service are an agreement between you and us. They cover:
- curtains.app, including the pages where you sign in, buy, activate devices and manage your account.
- Your Curtains account and plan, including teams.
Your use of the Curtains app is covered by the License Agreement, which is part of these terms. How we handle personal data is in the Privacy Policy.
Accepting these terms
You accept these terms when you create an account, which happens the first time you sign in, buy at checkout or activate a device. The page says so next to the button: “By continuing you agree to the Terms, including that Curtains may show your organization’s name and logo as a customer.”
You must be old enough to make a binding contract where you live. If you accept these terms for an organization, you confirm you’re allowed to do so, and “you” includes that organization.
Your account
- Your account is your email address. You sign in with a link we email you; there are no passwords. Keep access to that inbox safe, because anyone who can read it can sign in as you.
- One person per account. Don’t share an account. A team gives each person their own.
- Keep your email address current, so we can reach you about your account.
- You’re responsible for what happens in your account. Tell us at support@curtains.app if you think someone else has used it.
Plans
Today’s plans and prices are on the pricing page.
- Free costs nothing and has no time limit. It shares up to 2 windows at a time and keeps the “Shared with Curtains” badge on.
- The trial. Every new install gets Pro for 14 days from the first launch, with no account and no card. Then Curtains switches to Free by itself. There’s nothing to cancel.
- Pro is a yearly subscription for one person on up to 3 devices.
- Lifetime is a one-time payment for one person on up to 3 devices, with every future update. It’s a personal plan: it’s for you, not your team or organization.
- Pro for teams is a yearly subscription with a seat for each person who presents, 3 seats minimum. Each seat covers one person on up to 3 devices.
Every plan, Free included, gets every update. We may add, change or remove features over time, and we’ll describe changes in the changelog.
Buying through Stripe
Paid plans are sold through Stripe Managed Payments. Stripe is the seller of record (the merchant of record): when you buy a plan, you buy it from Stripe, which resells it. Stripe takes your payment, adds and pays any sales tax or VAT, sends your receipts and handles your billing. Stripe’s terms for the purchase apply to it: https://link.com/terms#sold-through-link-terms.
We remain the developer and licensor of Curtains. We’re responsible for the app, your account and your plan, and these terms and the License Agreement govern how you may use them.
Prices on the pricing page are before tax. Stripe adds any tax that applies where you live at checkout.
Subscriptions and renewal
- Pro and Pro for teams renew automatically every year, at the then-current price, until you cancel. Stripe charges the payment method on file at each renewal.
- Cancel any time in the billing portal, from your account page on curtains.app. Your plan keeps working until the end of the year you paid for, then Curtains goes back to Free. Your settings, combos and themes stay.
- Price changes. If the price of your plan goes up, we’ll tell you by email before your next renewal, so you can cancel first.
- If a renewal payment fails and isn’t fixed, the subscription ends, and Curtains goes back to Free when your pass runs out.
Devices and passes
- Activating. You activate a device on curtains.app. We then issue a pass, a small signed file that Curtains checks on your device without going online. A pass works only on the device it was issued for.
- The limit. Pro and Lifetime cover up to 3 active devices for one person, and Pro for teams up to 3 per seat. Free works on any number of devices.
- Moving to a new device. Remove an old one from your account page, or use Deactivate this device in the app. You can remove up to 3 devices yourself in any 12 months; email support@curtains.app if you need more.
- Renewing a pass. A Pro or team pass covers the year you paid for, plus 14 days. Renew it in one click from the app’s Account page, or turn on Renew my pass automatically.
- Don’t get around the limits. Don’t copy, share, sell or forge passes, or use one plan on more devices or for more people than it covers.
Teams
- The team owner is the person who buys Pro for teams. The owner invites members by email, can remove them, and can add seats at any time. Added seats are charged right away for the rest of the year; removed seats come off at the next renewal.
- Members sign in with their own email address and accept the invite. A member’s account is their own, and they can delete it at any time.
- What the owner sees: the team’s members and invitees by email address, and the seats used. Not members’ devices, and nothing from anyone’s screen.
- Removing a member frees their seat. A pass already on their device keeps working until it runs out, and can’t be renewed.
- The owner is responsible for the team’s use of Curtains, and confirms that the organization has agreed to these terms.
Refunds
Stripe, as the seller, handles refunds under its own policies. Beyond that, refunds are at our discretion. The Refund Policy explains how to ask, and what happens next. Nothing in these terms takes away refund or cancellation rights the law gives you.
Your organization’s name and logo
By accepting these terms, you let us show the name and logo of the organization you use Curtains for on curtains.app, to say it’s a customer (for example in the “Used by teams at” row). This permission is free, worldwide and lasts until you ask us to stop. We use only the organization’s official logo files, unchanged, and we won’t suggest that it endorses Curtains.
To have your organization’s name and logo removed, email support@curtains.app from your account’s address, or have someone at your organization do so. We’ll take them down promptly.
Acceptable use
Use Curtains and curtains.app lawfully. In particular, don’t:
- Share, record or show content you don’t have the right to share, or that breaks the law or someone else’s rights.
- Record or broadcast people without the consent the law requires where you and they are.
- Try to get into another person’s account, or into parts of curtains.app or its servers you aren’t meant to reach.
- Overload, probe or disrupt curtains.app or the account server, including by automated sign-in requests.
- Resell, rent or share your account, plan or passes, except as Pro for teams allows.
What you share is yours
Curtains shows the windows you pick on a canvas on your own device. We never receive your screen, your windows or your ink, and we claim no rights to them. You’re responsible for what you share in your meetings, and for checking what’s on the canvas before you go Live.
If you send us feedback or ideas, we may use them without owing you anything.
Other services
Curtains works with meeting apps such as Zoom, Google Meet and Microsoft Teams, but isn’t made by, affiliated with or endorsed by them. Their terms apply to your use of them. Company names and logos are trademarks of their owners.
Changes to these terms
We may update these terms. We’ll post the new version here with a new effective date, and if a change matters, we’ll tell account holders by email before it takes effect. If you keep using your account after that, the new terms apply. If you don’t agree, you can cancel and delete your account. A change never applies to a dispute that started before it.
Ending your account
- You can stop any time. Cancel your subscription in the billing portal and delete your account from your account page on curtains.app. The Privacy Policy explains what’s deleted.
- We may suspend or close an account that breaks these terms, for example by forging passes or abusing the service. Where we can, we’ll tell you first and give you a chance to fix it. If we close your account for a reason that isn’t your fault, we’ll refund the unused part of a paid plan.
- If we ever stop offering Curtains, we’ll give you notice. Devices you’ve already activated keep their passes, and Lifetime passes don’t expire.
The sections on disclaimers, liability, disputes and the general terms keep applying after your account ends.
Disclaimers
We work hard to make Curtains reliable and to keep anything you didn’t pick off the canvas. But curtains.app and Curtains are provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the service will be uninterrupted or error-free, or that it will keep working the same way after changes to macOS, Windows or your meeting app.
Limitation of liability
To the extent the law allows:
- We’re not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill.
- Our total liability for any claim about Curtains or these terms is limited to the greater of the amount you paid for Curtains in the 12 months before the claim and US$25.
These limits don’t apply to liability that can’t be limited by law, such as for fraud, or for death or personal injury caused by negligence. If you’re a consumer in the EU or the UK, we’re liable under the law for foreseeable loss we cause by breaking these terms or by failing to use reasonable care and skill.
Indemnity
If you use Curtains for a business, you’ll defend and compensate us for claims by others that come from content you share with Curtains or from your breaking these terms. This doesn’t apply to consumers.
Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Before going to court, please email legal@curtains.app and give us a chance to resolve it; most problems can be fixed that way.
Any dispute that isn’t resolved goes to the state and federal courts located in New York County, New York, and you and we agree to their jurisdiction. Either of us may bring a claim in small claims court instead, where it qualifies.
If you’re a consumer, you keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts. EU consumers can also use their national consumer dispute bodies.
General
- Whole agreement. These terms, the License Agreement, the Refund Policy and the Privacy Policy are the whole agreement between you and us about Curtains. Stripe’s terms cover the purchase itself.
- If part doesn’t hold, the rest of these terms still applies.
- Not enforcing a term right away doesn’t mean we give it up.
- Transfers. You can’t transfer your account or these terms without our permission. We may transfer them to a company that takes over Curtains, and we’ll tell you if we do.
- Events beyond control. Neither of us is responsible for delays caused by events outside reasonable control.
- Notices. We’ll send notices to your account’s email address. Send legal notices to legal@curtains.app, or to Miscreants, LLC, 418 Broadway, Ste N, Albany, NY 12207.
